Berleaf Education – Goods & Products Agreement

1. General

These Terms and Conditions govern all purchases of physical and digital goods from Berleaf Education Pte Ltd (UEN 202446793D), referred to as “Berleaf Education”, “we”, or “us”.
By placing an order with us, you agree to be bound by these terms.

Nothing in these Terms and Conditions is intended to limit or exclude any rights you may have under the Consumer Protection (Fair Trading) Act or any other applicable Singapore law.

2. Services Provided

2.1 All orders are subject to availability and confirmation of payment.

2.2 Submitting an order form does not constitute a confirmed order. Your order is confirmed only upon receipt of full payment.

2.3 We reserve the right to cancel any order that remains unpaid within a reasonable period, without prior notice.

2.4 All prices are stated in Singapore Dollars (SGD). Prices are inclusive of applicable taxes unless stated otherwise and are subject to change without prior notice. Price changes do not affect orders that have already been confirmed.

3. Pre-Orders

3.1 For pre-order items, payment is collected in advance of the product's availability date.

3.2 Estimated fulfilment dates are provided in good faith and may be subject to change. Customers will be notified of any significant delays.

3.3 Pre-order payments are non-refundable if you change your mind after placing the order. If, however, a pre-ordered item cannot be fulfilled by Berleaf Education, a full refund will be issued.

4. Delivery & Collection

4.1 Berleaf Education offers self-collection and mail delivery options where stated.

4.2 Self-collection is available at our designated studio location during agreed hours. Details will be communicated upon order confirmation.

4.3 For mail delivery, orders are dispatched via standard postal services. Once an item has been dispatched, Berleaf Education is not liable for any delays, loss, or damage caused by third-party postal or courier providers.

4.4 You are responsible for providing accurate and complete delivery information. Berleaf Education is not responsible for non-delivery resulting from incorrect or incomplete addresses provided at the time of order.

4.5 Risk of loss or damage passes to you upon dispatch of the item.

5. Digital Goods

5.1 Digital products (including guides, downloadable resources, and digital worksheets) are delivered electronically via the link or method specified at the time of purchase.

5.2 Due to the nature of digital goods, all sales are final once the file has been delivered or the download link has been accessed. No refunds will be issued on digital products except where the file is technically defective and cannot be opened or used.

5.3 If you experience a technical issue with a digital product, please contact us within 7 days of receipt.

6. Product Quality

We warrant that all physical goods supplied by Berleaf Education are of merchantable quality and materially conform to any description provided at the time of sale. This warranty does not apply to damage caused by mishandling, improper storage, or use inconsistent with the intended purpose of the product.

7. Cancellations and Missed Lessons

• Cancellations after the schedule is confirmed are considered forfeited.
• Fees for missed, canceled, or forfeited sessions are strictly non-refundable and cannot be offset against future sessions, regardless of reason.

7. Returns & Exchange

7.1 All sales are final. We do not accept returns or issue refunds except in the circumstances stated below.

7.2 If you receive a defective or damaged physical item, please contact us within 7 days of receipt via WhatsApp at +65 8834 5681 or email at berleafedu@gmail.com with a description and photograph of the issue.

7.3 Approved exchanges will be fulfilled subject to stock availability. Where a replacement cannot be provided, a refund for the affected item will be issued.

7.4 Items returned without prior approval will not be accepted.

8. Intellectual Property

8.1 All content, materials, and products sold by Berleaf Education – including but not limited to books, guides, worksheets, and digital resources – are the intellectual property of Berleaf Education Pte Ltd and are protected under applicable copyright and intellectual property laws.

8.2 Purchase of a product grants you a personal, non-commercial licence to use the material for your own learning or the learning of the individual it was purchased for. You may not reproduce, distribute, resell, publicly share, or adapt any purchased materials – in whole or in part – without prior written consent from Berleaf Education Pte Ltd.

9. Personal Data Protection

9.1 Berleaf Education collects personal data (such as your name, contact details, and delivery address) solely for the purposes of processing your order, providing customer support, and communicating with you about your purchase.

9.2 We comply with the Personal Data Protection Act 2012 (PDPA) of Singapore. Your data will not be sold or disclosed to third parties without your consent, except where required by law or necessary to fulfil your order (e.g. postal or courier services).

9.3 To request access to, correction of, or withdrawal of consent for your personal data, please contact us at berleafedu@gmail.com.

10. Force Majeure

Berleaf Education will not be held liable for any failure or delay in fulfilling an order that is caused by circumstances beyond our reasonable control, including but not limited to natural disasters, public health emergencies, postal disruptions, government restrictions, or supplier failures. In such cases, we will notify you as soon as practicable and either fulfil the order when circumstances allow or issue a full refund.

11. Personal Data Protection

11.1 Berleaf Education shall not be liable for any indirect, incidental, or consequential loss arising from the purchase or use of our products.

11.2 Our liability in any dispute is limited to the value of the order in question.

12. Dispute Resolution

We encourage you to contact us first if you have a concern about your order. We will make every effort to resolve any issue promptly and fairly. If a dispute cannot be resolved amicably, it shall be subject to the exclusive jurisdiction of the courts of Singapore.

13. Governing Law

These Terms and Conditions are governed by the laws of the Republic of Singapore.

14. Update to These Terms

Berleaf Education reserves the right to update these Terms and Conditions at any time. The most current version will always be published at this page. Continued use of our products or services after any update constitutes acceptance of the revised terms.
